The dissemination of content containing third parties’ personal data (ex. their images, voices, or names, etc.) requires, in majority of cases, a prior consent of the person concerned.
Before uploading content on Dailymotion, it is your responsibility to ensure that the person(s) whose image, voice or other personal data are included in your content has/have consented to this publication.
This rule also applies to posts including images of your children.
In France, the rights of minors under the age of 15 are exercised jointly by their legal representatives. Starting from the age of 15, children have a right to make their own decisions when it comes to the sharing of their personal data (including their images). This means that your 15 years old can refuse you post a photo or video of them online.
Sharenting
Many parents share daily moments of their children's lives online. This practice, otherwise called “sharenting” (a combination of “sharing” and “parenting”), is not a trivial act and involves many risks.
Indeed, photos and videos of your children published online may:
- Be misused and exploited inappropriately, in particular by pedo-criminals' networks.
- Provide a lot of information about your child's life: ex. their school, sports club or place of residence.
- Remain permanently accessible to all Internet users.
In addition to being simply embarrassing to your kids, sharing such information may create or encourage situations of harassment, online or offline.
CNIL Recommendations
In France, the National Commission for Information Technology and Liberties (CNIL) reminds that minors have digital rights and strongly advises against sharing photos or videos of your children on social networks.
For more information visit the CNIL website where you will find numerous resources and recommendations addressing the exploitation of images of children.
Limit the visibility of your posts on Dailymotion
Dailymotion allows you to limit access to the videos you publish on our platform. From your account, activate “private” mode for any of your videos and share them only with the people of your choice by sending them a link. You can also password protect your videos.
Good practices:
- Before posting ask for your child’s and the other parent’s consent
- If possible, avoid sharing certain photos/videos and hide your child's face
- Secure your accounts and reduce the visibility of your posts
